These Terms & Conditions ("Terms") govern access to and use of privatelivingmexico.com (the "Website"), which is operated by Carlos Ochoa González under the trade name Private Living ("Private Living," "we," "us" or "our").

By accessing or using the Website, you acknowledge that you have read and agree to these Terms. If you do not agree, please do not use the Website.

1. Purpose of the Website

The Website provides general information about Private Living, its residence-management and coordination services, and topics relevant to second-home ownership in Los Cabos.

Website content is informational only. It does not constitute a binding service proposal, professional opinion, technical inspection, warranty or promise that a particular service, provider, result or response time will be available.

2. No Service Relationship Created Online

Submitting an inquiry, sending an email, downloading a resource, requesting a consultation or communicating through the Website does not by itself create a client, agency, fiduciary, property-management, advisory or other professional relationship.

A service relationship begins only when the applicable written proposal, agreement, scope, authorization and payment requirements have been accepted by the relevant parties.

If a signed client agreement conflicts with these Website Terms regarding contracted services, the client agreement will control for those services.

3. Eligibility and Authority

You may use the Website only if you have the legal capacity to do so. If you submit information on behalf of another person, residence, company, trust or entity, you represent that you have authority to provide the information and request the communication.

The Website is not directed to minors. A minor may not submit personal data or request services through the Website.

4. Permitted Use

You may access and use the Website for lawful, personal and informational purposes. You may not:

1.   Use the Website in violation of applicable law or the rights of another person.

2.   Attempt to gain unauthorized access to the Website, forms, accounts, servers or connected systems.

3.   Introduce malicious code, interfere with security or disrupt Website operation.

4.   Scrape, harvest or collect information through automated means without written permission.

5.   Misrepresent your identity, authority, relationship to a residence or purpose for contacting Private Living.

6.   Copy, republish, modify, sell or exploit Website content except as expressly permitted by law or written authorization.

7.   Use Private Living's name, marks, content or imagery in a manner that suggests endorsement, affiliation or authorization where none exists.

5. Intellectual Property

The Website and its original text, branding, service descriptions, graphics, photographs, icons, layout, downloadable resources and other content are owned by or licensed to Private Living and are protected by applicable intellectual-property laws.

Private Living grants users a limited, revocable, non-exclusive and non-transferable right to view the Website for personal informational use. No ownership rights are transferred.

Third-party names, marks, photographs and content remain the property of their respective owners.

6. Accuracy and Availability of Information

Private Living aims to present useful and current information, but conditions in Los Cabos, service availability, provider schedules, regulations, event dates, prices and property requirements may change.

We do not warrant that all Website content is complete, current, error-free or suitable for a particular residence. Users should verify material information with the appropriate authority or qualified professional before relying on it.

We may modify, suspend or discontinue any part of the Website or its resources without notice.

7. Service Descriptions

Descriptions of Home Watch, residence management, owner representation, household administration, project oversight, private-asset coordination, relocation support, concierge services and family coordination describe possible areas of support.

Actual services depend on location, residence conditions, capacity, risk, provider availability and the written scope accepted for the engagement. No service is included merely because it appears on the Website.

8. Independent Providers

Private Living may describe or coordinate services performed by independent contractors, vendors, advisers, household personnel or licensed professionals. Unless a written agreement expressly states otherwise, those third parties are independent and remain responsible for their own advice, licensing, pricing, personnel, insurance, acts, omissions, workmanship and warranties.

Mentioning, introducing or coordinating a provider does not guarantee the provider's availability, suitability or performance.

9. No Emergency Use

The Website, inquiry forms and email are not monitored as public emergency channels and must not be used to report an immediate threat to life, safety or property.

For a police, fire, medical, rescue, security or other emergency, contact the appropriate public authority or contracted emergency or monitoring provider first.

10. Communications and Submissions

When you submit information through the Website, you agree that Private Living may use the contact details provided to respond to the inquiry and communicate about the requested service, subject to the Privacy Notice.

You are responsible for ensuring that information submitted is accurate and that you are authorized to provide it. Do not send access codes, bank credentials, payment-card information, government identification documents, medical records or other sensitive information through the general inquiry form.

Electronic communications may be delayed, intercepted, misdirected or affected by technical problems. If a matter is time-sensitive and you have an existing service relationship, use the communication method stated in your service agreement.

11. Privacy and Cookies

Personal data is processed according to the Privacy Notice. The Website may use cookies and similar technologies as described there and through any cookie-preference tool made available on the Website.

12. Third-Party Websites and Embedded Services

The Website may contain links to or embedded content from independent websites, maps, social networks, scheduling tools, videos or other services. Private Living does not control those services and is not responsible for their content, availability, security, terms or privacy practices.

A link or reference does not necessarily constitute endorsement. Users access third-party services at their own discretion and should review the applicable terms and privacy notices.

13. Professional Limitations

Website content does not constitute legal, tax, accounting, financial, investment, medical, psychological, insurance, architectural, engineering, environmental, appraisal, construction, security or real-estate brokerage advice.

Private Living provides practical coordination and owner representation within the scope of a written engagement. Regulated or technical matters must be addressed by the appropriately qualified independent professional. Additional limitations appear in the Professional Disclaimer.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided on an "as available" and informational basis, without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, non-infringement, error-free operation or freedom from harmful components.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Private Living will not be liable for indirect, incidental, special, consequential or punitive loss arising solely from access to, inability to use or reliance on the Website or third-party content.

This Website limitation does not alter liability that may arise under a separate signed client agreement and does not exclude liability that cannot lawfully be limited, including mandatory consumer rights where applicable.

16. Responsibility for Misuse

You are responsible for losses, claims or reasonable costs arising from your unlawful misuse of the Website, infringement of another person's rights, or submission of information that you were not authorized to provide, to the extent permitted by applicable law.

17. Governing Law and Jurisdiction

These Terms are governed by the applicable federal laws of Mexico and the applicable laws of the State of Baja California Sur.

Subject to any mandatory consumer or jurisdictional rights that cannot be waived, disputes concerning use of the Website will be submitted to the competent authorities and courts located in Los Cabos, Baja California Sur, Mexico.

18. Changes to These Terms

Private Living may update these Terms to reflect changes in law, Website operation or business practices. The current version and last-updated date will appear on this page. Continued use of the Website after an update constitutes acceptance to the extent permitted by law.

19. Severability and No Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
